Telehealth and pharmacy informed consent
Consent to receive care through telehealth
Please read this consent carefully. It explains telehealth services, clinical review, prescriptions, pharmacy coordination, privacy, and your choices as a patient. You may ask questions before accepting it. Where required, your electronic or verbal consent will be documented in your medical record before telehealth services begin.
1. Not emergency care
This website, questionnaires, telehealth visits, email, and secure messages are not emergency services and are not monitored continuously. Call 911 or go to the nearest emergency department for a medical emergency, severe or rapidly worsening symptoms, thoughts of self-harm, or another urgent concern.
2. Who may provide your medical care
Apex Vitality is operated by Elite Functional Health, a Professional Nursing Corporation. California care may be provided by Apex Vitality clinicians. For eligible Qualiphy-supported services, Qualiphy operates the clinical technology and booking platform and connects you with an independent telehealth medical group and a clinician licensed where you are located. Your treating clinician—not the website, marketing team, pharmacy, or payment processor—makes all medical decisions. The clinician's identity and professional credentials will be disclosed through the Qualiphy clinical workflow before care is provided.
The Qualiphy-supported pathway is currently available in 48 states and Washington, D.C., and is not available in Alabama or Mississippi. Service availability depends on your physical location at the time of care, clinician licensure, the medical group's service area, pharmacy availability, and applicable law. Apex Vitality does not represent that every service is available in every state.
You will also be asked to accept the applicable Qualiphy, medical-group, and state-specific notices and consents before care is provided.
3. Nature of telehealth services
Telehealth uses electronic communication when you and the clinician are in different locations. Services may include review of your medical history and records, electronic questionnaires, photographs or measurements you submit, secure messages, telephone or video consultation, assessment, diagnosis, treatment recommendations, laboratory orders, prescriptions, monitoring, referrals, and follow-up. A consultation may be asynchronous or live, depending on the service, your state's requirements, and the clinician's judgment.
4. A medical consultation is required
A licensed clinician must independently review the information you provide and complete an appropriate clinical evaluation before a prescription can be issued. Completing a questionnaire, selecting a treatment, making a payment, or enrolling in a membership does not guarantee a diagnosis, prescription, dose, laboratory order, or treatment result. The clinician may request additional information, testing, a live consultation, or an in-person examination, recommend a different option, or decline treatment when it is not clinically appropriate or legally permitted.
5. Your medical information and responsibilities
You agree to provide complete, truthful, and accurate identity, location, health history, medication, supplement, allergy, pregnancy, laboratory, and contact information and to update it when it changes. The clinician relies on this information when making medical decisions. Missing or inaccurate information can create medical risk or result in delayed or declined treatment.
Participate from a reasonably private and safe location, do not drive during a visit, identify anyone else who is present, follow agreed testing and monitoring, use medication only as directed, and promptly report significant side effects or changes in your condition. The clinician may confirm your identity, physical location, and emergency contact information.
6. Benefits, risks, and limitations
Telehealth can improve access, reduce travel, support timely review, and allow care from a convenient location. Its limitations include the absence of a hands-on examination, reliance on information you provide, incomplete records, technology or communication failures, delays, and privacy or security risks inherent in electronic communication. Some conditions cannot be evaluated or treated safely through telehealth. If telehealth is not appropriate, you may be directed to in-person, urgent, emergency, or specialty care.
7. Prescriptions, testing, and follow-up
If treatment is approved, the clinician may prescribe medication in accordance with professional judgment, clinical standards, and applicable law. Approval may depend on laboratory testing, medical records, identity verification, a live consultation, or ongoing monitoring. Prescriptions may be changed, paused, or discontinued when medically appropriate. Telehealth does not replace your primary care clinician, and you should continue routine and preventive care.
8. Pharmacy services and your pharmacy choice
Apex Vitality is not a pharmacy. When a prescription is issued, it may be sent to an independent licensed pharmacy or pharmacy network for processing, dispensing, and delivery. A pharmacy may transfer the prescription when permitted or required by law and may contact you or the prescriber for additional information. Pharmacy availability, formulation, pricing, and delivery time can vary by location.
You may ask to use another pharmacy when the prescription and applicable law permit it. Some bundled or membership pricing may apply only when the identified pharmacy network is used. The specific pharmacy, included services, transfer process, and any separate costs will be disclosed through the applicable program or pharmacy workflow.
9. Compounded medication
If your plan includes compounded medication, it will be prepared by an independent licensed pharmacy pursuant to a patient-specific prescription. Compounded drugs are not FDA-approved, and the FDA does not review their safety, effectiveness, or quality before marketing. Formulation, concentration, appearance, packaging, beyond-use date, and availability may vary by pharmacy. Your clinician will provide material treatment information and answer your questions as part of your care.
10. Privacy, records, and electronic communication
Clinical information may be handled by Apex Vitality, the treating medical group, clinicians, laboratories, pharmacies, and technology providers as permitted by law and described in their applicable privacy notices. Use the designated secure patient platform for medical information. Ordinary email and text messages may not be fully secure. You may request access to your medical records as permitted by law. Neither you nor the clinician may record a telehealth interaction without the consent of everyone involved.
11. Fees, subscriptions, and insurance
You are responsible for the fees disclosed before purchase and for pharmacy, laboratory, shipping, or other third-party charges unless they are expressly listed as included. Payment or membership enrollment does not guarantee treatment approval. If treatment is declined, the refund or alternative-care terms disclosed for the applicable purchase will apply. Apex Vitality does not guarantee insurance coverage or reimbursement.
12. Technical interruptions and follow-up
If a live visit disconnects, attempt to reconnect and follow the clinician's instructions. If your condition becomes urgent, do not wait for the connection to be restored. Technology failures may delay evaluation, communication, or delivery of information. Contact the treating clinician or designated support channel for non-urgent follow-up questions.
13. State-specific rights and disclosures
Telehealth rules and required notices vary by state. Disclosures that apply where you are physically located may be presented during intake, account creation, or the clinical visit and become part of this consent. These may include information about clinician credentials, professional-board contacts, medical-record sharing, complaint procedures, live-consultation rights, follow-up care, and available alternatives. Nothing in this consent limits rights that cannot be waived under applicable law.
14. Alternatives, withdrawal, and questions
You may ask questions, decline telehealth, or withdraw this consent at any time without losing your right to seek future care. Withdrawing consent does not affect care already provided and may prevent continuation of a service offered only through telehealth. Alternatives include seeking in-person care or care from another available clinician.
15. Your acknowledgment
By selecting an electronic consent option, signing this consent, or verbally consenting after receiving this information, you acknowledge that you have read or had the opportunity to review this notice; understand the nature, potential benefits, risks, limitations, and alternatives of telehealth; understand that no prescription or result is guaranteed; have had an opportunity to ask questions; consent to telehealth services; and authorize documentation of your consent in the medical record.
This consent works together with the Terms of Service, Privacy Notice, and any medical-group, pharmacy, program, or state-specific notices presented to you during the applicable workflow.
