Terms of service

Terms for using Apex Vitality services

These Terms of Service govern your use of this website and the services offered by Apex Vitality. By using the website, creating an account, submitting an intake, scheduling care, or purchasing a service, you agree to these terms and our Privacy Notice. Telehealth services are also governed by our Telehealth Informed Consent.

1. Who we are

Apex Vitality is operated by Elite Functional Health, a Professional Nursing Corporation. California care may be provided directly by Apex Vitality clinicians. For eligible Qualiphy-supported services, Qualiphy operates the technology and booking platform and connects patients with an independent medical group and a clinician licensed in the patient's state. The treating clinician and medical group—not Apex Vitality's website, Qualiphy's nonclinical platform services, the pharmacy, or the payment processor—are responsible for medical evaluation and treatment decisions.

2. Eligibility and service area

Apex Vitality currently serves adults age 18 and older. Direct Apex Vitality clinical care is available in California. Eligible Qualiphy-supported services are available in 48 states and Washington, D.C., but are not currently available in Alabama or Mississippi. Availability also depends on the selected service, clinician licensure, pharmacy coverage, and applicable law. See the Service Areas page. You must provide accurate identity, contact, physical location, shipping address, health, medication, and payment information and may not use another person's identity or account.

3. Not emergency care

Apex Vitality, this website, questionnaires, email, and secure messages are not emergency services and are not monitored continuously. Call 911 or seek immediate in-person care for a medical emergency, severe or rapidly worsening symptoms, thoughts of self-harm, or another urgent concern.

4. Website information

Website articles, descriptions, illustrations, and other general information are educational and do not replace individualized medical care. They are not a diagnosis, prescription, or guarantee that a particular treatment is right for you.

5. Starting care

Completing a questionnaire, making a payment, or requesting an appointment begins the care process but does not by itself establish a clinician-patient relationship or guarantee a prescription. A clinician-patient relationship begins only when a licensed clinician accepts your care and provides an appropriate clinical evaluation. Your clinician will work with you to understand your history, symptoms, lifestyle, and goals and develop a personalized plan.

6. Telehealth services

Care may be provided through video, telephone, secure messaging, electronic questionnaires, record review, or other legally permitted telehealth methods. Before telehealth care is delivered, you will be asked to acknowledge the Telehealth Informed Consent. A clinician may recommend an in-person examination, testing, urgent evaluation, or another level of care when useful for safe and effective treatment.

7. Prescriptions and treatment plans

Treatment is individualized. Purchasing a program does not guarantee any particular medication, dose, laboratory order, supplement, or outcome. Prescriptions are issued only when a licensed clinician determines they are clinically appropriate and legally permitted. You agree to use medication only as directed, disclose all medications and relevant health information, complete requested monitoring, and promptly report adverse effects.

8. Compounded medications

Some plans may include a compounded medication prepared by an independent licensed pharmacy pursuant to a patient-specific prescription. Compounded drugs are not FDA-approved, and the FDA does not review their safety, effectiveness, or quality before marketing. Formulation, concentration, appearance, packaging, beyond-use date, and availability may vary by pharmacy. Your clinician will discuss material treatment information and alternatives as part of your care.

9. Pharmacies, laboratories, and other third parties

Pharmacies, laboratories, payment processors, delivery carriers, and technology platforms are independent third parties with their own terms and privacy practices. Apex Vitality may coordinate with them but does not control their operating hours, inventory, turnaround times, shipping, or service interruptions. Delivery dates are estimates. You are responsible for providing a complete delivery address, promptly retrieving packages, and following storage instructions.

Patients using the Qualiphy-supported pathway must also review and accept the clinical workflow's applicable notices and consents. Qualiphy's current Terms of Use describe its platform role and its relationships with independent medical groups, clinicians, laboratories, and pharmacies.

10. Prices, payments, and insurance

Prices are shown in U.S. dollars. The checkout page identifies what is included in a purchase. Medication, laboratory testing, supplements, shipping, imaging, or other outside services are separate unless expressly listed as included. Payments are processed through Stripe or another identified processor. By submitting payment information, you authorize the stated charge. Apex Vitality is a cash-pay practice unless expressly stated otherwise and does not guarantee insurance reimbursement.

11. Provider-review purchases and refunds

Some programs allow you to pay and submit a health questionnaire before clinician review. If the reviewing clinician does not authorize the selected prescription, Apex Vitality will contact you about next steps. You may receive a refund for the undelivered medication or program portion, or choose another offered care option. Any nonrefundable clinical-review fee will be clearly disclosed before purchase. Prescription medications generally cannot be returned or refunded after a pharmacy has prepared or shipped them, except when required by law or under the pharmacy's written policy.

12. Appointments, cancellations, and missed visits

Appointments canceled or rescheduled at least 24 hours before the scheduled start time are eligible for a full refund or account credit. Cancellations made with less than 24 hours' notice and missed appointments are subject to a $150 fee; any remaining prepaid appointment balance will be returned to the original payment method. If Apex Vitality cancels an appointment, you may reschedule or receive a full refund. Approved refunds are submitted promptly, but your bank or card issuer controls when the credit appears.

13. Memberships and recurring charges

If you purchase a recurring membership, the price, billing interval, included services, and renewal terms will be shown before checkout. By enrolling, you authorize recurring charges to your payment method until cancellation. You may cancel before the next renewal through the secure patient portal or the stated customer-service method. Cancellation stops future renewals. Fees already paid for the current period are not prorated or refunded except when required by law or agreed in writing.

14. Electronic communications

You consent to receive service-related electronic communications, including appointment, account, payment, questionnaire, and care notifications. Standard message and data rates may apply. Email and text messages may not be fully secure; use the Charm patient portal for medical information and care-related messages. You may manage optional marketing communications separately from essential service communications.

15. Your account and security

You are responsible for protecting your passwords, device access, and account credentials and for promptly reporting suspected unauthorized access. Do not share a patient account or use another person's credentials. You are responsible for reviewing and responding to time-sensitive care and account communications.

16. Privacy

Clinical information is handled in accordance with applicable privacy laws and Apex Vitality's Notice of Privacy Practices. See our website Privacy Notice. Do not submit protected health information through ordinary email or unsecured website channels.

17. Acceptable use and intellectual property

You may use this website only for lawful personal purposes. You may not interfere with the website, attempt unauthorized access, submit false information, misuse another person's account, or reproduce Apex Vitality content for commercial use without written permission. Website text, branding, graphics, and original materials belong to Apex Vitality or their respective licensors.

18. Website availability and third-party links

Apex Vitality may change, suspend, or discontinue website features or services. The website is provided on an as-available basis, and uninterrupted or error-free access is not guaranteed. Links to third-party sites are offered for convenience and do not make Apex Vitality responsible for their content, security, availability, or practices.

19. No guarantee of results

Health outcomes vary. Apex Vitality does not guarantee a particular diagnosis, prescription, response, result, or timeline. Nothing in these terms limits professional duties, patient rights, or liability that cannot legally be limited.

20. Suspension or termination

Apex Vitality may restrict or end website or account access for unlawful, fraudulent, abusive, unsafe, or materially disruptive conduct, nonpayment, or violation of these terms. Ending access does not remove payment obligations already incurred or legally required duties concerning medical records and continuity of care.

21. Disputes and governing law

Before filing a non-urgent dispute concerning the website, payment, or services, you and Apex Vitality agree to make a good-faith effort to resolve it through written customer-service notice. These terms are governed by California law, without limiting patient rights or other rights that cannot be waived.

22. Changes, assignment, and severability

Apex Vitality may update these terms as services or law change. The effective date identifies the current version. Continued use after an update means you accept the revised terms. You may not transfer your account or rights under these terms without written permission. Apex Vitality may assign these terms as part of a lawful reorganization, merger, or transfer of the service. If a provision is found unenforceable, the remaining provisions continue to apply to the fullest extent permitted by law.

23. Entire agreement and questions

These terms, the Privacy Notice, the Telehealth Informed Consent, and any program-specific terms presented at checkout form the agreement concerning the service. Use the contact page for customer-service questions and the secure Charm patient portal for care-related questions. Do not use ordinary email for sensitive medical information.
